I was cited for underage drinking by ECU police and I was holding a plain red cup, wasn't intoxicated (yet) and they hadn't seen me take a drink. All of this was admitted in court and I received a prayer for judgement.

Things could have been handled differently, but what it comes down to is this. RA's get compensated for doing a JOB. Like any job, you answer to your employer or whomever writes the checks. When put in a situation where its either the possibility of losing your job for not performing your duties or performing your duties to keep your job, you are gonna cash that check on Friday...'nuff said.

^^ the RD doesn't have clean hands on this issue either. because she supports it the issue will have to go much higher before dying. but with those two you have it covered.

^ true, and it also looks like they don't currently have any intention of backing off on the charges. or at least haven't announced any. next is the individual hearings or whatever, but given the shat load of people who strongly oppose it, i say it could go either way. could be interesting, will they back off? will the slope get slipperier?

^^ i agree, but i think it can still be a close argument. they're not THAT far apart. Underage drinking is still a crime according to the law books. But the differences start; This doesn't show any underage drinking, it's a university policy issue and not a legal one.

But in the case that someone has a picture online of themselves breaking into a car, could you really prosecute that person? I'm not even sure if it could lead to an investigation leading to a case provided that other clear evidence was found. And sure as hell, one single digital picture isn't sending anyone to jail by itself.

Well, upon reflection of the statement, I would protest the use of a picture of someone breaking into a person's car on campus if it was the begin-all end-all of the case. I think most people would...

A friend asked me to say this

Quote :
"The quotes are taken from the Facebook.com terms of use (which the RA had
to have agreed to in order to access the pictures, since you can't see
Facebook pictures without joining Facebook and thereby agreeing to their
terms of service), which is available at http://ncst.facebook.com/terms.php .

Basically, she seems to have violated the terms of use by downloading
republishing the property of Facebook (the photos) to another entity in a
non-personal use of the info, in an arguably defamatory manner (she's
using it to make allegations that are not clearly true) and a manner that
violates privacy rights, as well as a manner that intimidates and harasses
others.

And, therefore, the RA used illegally obtained evidence as the basis for
her citations. And, therefore, they are invalid.
"

The quotes from the facebook cite my friend mentioned are:

Quote :
"You understand that the Web site is available for your personal,
non-commercial use only. You agree that no materials of any kind submitted
through your account will violate or infringe upon the rights of any third
party, including copyright, trademark, privacy or other personal or
proprietary rights; or contain libelous, defamatory or otherwise unlawful
material.

...

In addition, you agree not to use the Web site to:
...
• intimidate or harass another;

...

All content on Web site, including but not limited to design, text,
graphics, other files, and their selection and arrangement (the
"Content"), are the proprietary property of Facebook or its licensors. All

Ok, this is a long post but hopefully worth it. I’ve been up since the article came out around 1:30am trying to get in touch with those involved and those who can help push to get this overturned. I feel what happened was intrusive and unacceptable; pretty much what appears to be what every student feels after looking at what everyone has posted in this thread. But regardless, I don’t feel the administration feels that way and especially those in line to decide the fate of the students involved.

Before I go on, there are some things which would be ok at this point to mention that have reported incorrectly or were a bit vague. First, the facebook was used to find the photos, but the photos weren’t explicitly on the facebook that all the students are being cited for. A good many were listed on a Webshots account owned by one of the students involved. Also, regardless of how absurd using digital pictures may seem to cite someone on, RA’s can do this if they can reasonably prove that the people in the pictures are the same people living in their residence hall. With complete administrative discretion granted to those in University Housing, this stuff can and will fly if people up and down the line are ok with it. The RA and RD are obviously ok, otherwise it would not have got to this point.

In University Housing, people can be cited for things that aren’t necessarily against any state laws, but unless you fight the charges, they’ll be stuck to you. People during my freshman year here were written up for taking out recyclables if they were seen with empty alcohol containers and also another person I know of was cited for helping someone who was sick after drinking, although she had not had any alcohol herself. In Wood Hall there was a case where a guy got busted for a party he held well afterwards when the RA somehow got hold of pictures later on. So what is happening here is not too far fetched... people spoke of this leading to a slippery slope but with University Housing we’re very much already on that slope now.

This is going to have to go way up to be overturned. After speaking with others, I have good reason to believe Dr. Luckadoo will not go against what the RA and RD are pushing. Susan Grant I doubt isn’t on the side of going against this either judging from the ABC11 article. Next in line beyond Luckadoo is Dr. Stafford, which will be a hoot to get him to do anything about it. If this results in students being kicked out of housing or being sent home, I feel there will be support enough to take this higher and get others involved. Something coming before the BoT would not be out of the question if people will stick with it to get it that far.

As of now, I have several people I’ve talked to in Student Government who agree with me and are committed to pushing to get something done. We’re still chasing the idea of how would be best to approach this formally, but some of the ideas already out there are to hold a public meeting or forum, invite in members from University Housing or other administrators (Dr. Stafford being a possibility) to show how all of us feel regarding this. Some people are really open an willing to take how we feel into account, Susan Grant for one has been in my judgment very receptive, however other administrators don’t deserve any high marks for how they’ve consistently behaved in spite of student opposition. But a meeting alone I seriously doubt is going to solve much if anything. One positive change that can be made is looking to get University Housing or the Board of Trustees (BoT) to change existing policies to be more explicit, possibly making it to where things of this nature in the future would not be something eligible to be written up for. But this would have to be a long-term affair and would require some legwork on the part of students who would be willing to see it through... Student Government could help there if enough of those elected feel it is important to them, but that is left to be seen. To do something like this would not be a spur of the moment venture. Another group working to do something similar is the Inter-Residence Council Emerging Issues Committee. Right now they working to present changes to the BoT regarding a visitation policy change (currently only members of the same sex can remain in residence hall rooms after 1-2am provided the roommate allows and the RA is contacted, however it doesn’t go for opposite sex... they are looking to make it so where a visitor of any sex can remain after-hours provided the roommate is ok with it – some people don’t think it is a big issue, but it is in places where people enforce it and I know RAs that do; I got caught twice last year and seriously threatened, although let off) and this may be something that they could follow up on too. But it takes people, and it takes time to make any difference. A lot of students just don’t care, and a lot of people are tied with other things. Now it’s Katrina Relief, Tuition, the J-Board split, among a variety of other things as well.

But for the immediate future you should be seeing some effort coming out of Student Government to oppose this, and hopefully IRC or Alexander if either want to mobilize around this issue. It would be a big help if you guys want to do something about this. I know if a few students here are willing to make a commitment to get together and attend an hour long meeting every week or two for the year, I know the people who would be more than willing to see that something meaningful gets done. If you want to help out, please do! Here is some ways how:

Go here and contact all the students elected to represent your college and tell them that you want them to look into this. Tell them that if they aren’t doing anything they need to get off their ass and start to do something to address the policies that allow RA’s and RD’s the freedom to cite students with violations like this. These are people you choose to follow issues like this, it is their job and they are supposed to be working for you so tell them that “THIS IS WHAT I WANT YOU TO DO BECAUSE THIS MATTERS TO ME, GET ON IT.”
http://students.ncsu.edu/senate/matrix.php

Also contact other students that already are involved with issues similar to this, Ash Divecha is one, he is the chair of the Emerging Issues Committee in the Inter-Residence Council. Tell him you care about this and knowing him personally I feel you will receive a positive response. His email is: adivecha@gmail.com

I’m willing to keep anyone who is interested up to date with the more structured things that are going on. There will be a meeting on this sometime, even if these particular charges are dismissed; University Housing has clearly crossed a line by allowing it to make it this far and no one is going to be there to fight for individual students who will get hit with something like this later... just think if one person in Alexander got cited, it wouldn’t have been as hyped. Now is the time to do something and if you’re willing to come out and share your opinions with administrators who have part in making a difference, I’ll keep you informed with the details. Just send me an email at: jmsevits@ncsu.edu I will personally help anyone who wants to become part of the organized effort to make a difference on this matter. If you are interested in helping directly, putting some time and effort into this, email me, I can tell you how.

Quote :
" something I find funny is that Alexander is for the "international" students, ... The irony is that in most other countries the drinking age is 18 or lower, thus should alexander not be flexable if not considered "wet" ... if you are going to call yourself an "international community" then at least attempt to be more welcoming.... this is all such a damn joke and absolutly pathetic on the part of University Housing "

Agreed. University Housing traditionally is more loose about enforcing the alcohol policy in Alexander. Also students are afforded a bit more freedom; it is the only residence hall on campus where smoking is permitted inside. This one RA though obviously decided it was her duty to crack down on those students who she felt violated the policy... others are more tolerant as most reasonable people would feel they should be.

Quote :
" If this person is smart enough to bring this before the judicial board, let it blow up,"

What judicial board?!? This is an admin decision all the way, the offence is not serious enough to be expelled or suspended from the University for, but I do feel bad for the international students who were cited. It is a legitimate concern now of some students who were planning to stay an additional semester of being the equivalent of expelled by not being able to stay in Alexander. No one has talked about this yet here, but it is something that needs to be taken seriously and is an issue being discussed in the hall.

Another thing that I feel that needs to be taken seriously is if this stands, what new precedence does it set. Brentroad/thewolfweb, xanga, livejournal; nothing is off bounds, is it? If we’re already ok with this and students don’t do anything, this can extend further if you get an RA willing to be a zealot. Also with University policy, if you get caught off campus for misc. violations you can be referred to the University – and if you get a nut administrator, policy that affords a lot of freedom of enforcement can work against our best interests.

I realize this post was long, but I had a lot to say. I hope all of you will continue to. If you don’t let this issue die and do something about it, it will not die. When interests wane, changes are rarely made. Again, if you want to become involved in an organized effort regarding this issue email me.

I was referring to those girls suing the RA. JSWFB... wow good job man. I wish we had people like you when I was in college.

I had just finished writting a 50 page paper that my deadline was cut by 2 weeks so i had 3 days to write it. I woke up, wrote, ate, wrote more, at again wrote more... for three fucking days. At the end my keyboard died about 2 minutes after i hit the "Save" and "Printed". So i got a bunch of people together and they watched as I went to the 3rd story window at turlington and tossed that thing straight down and it blew to pieces.

Now sure that was stupid, but it was 9pm at night an noone was near. I even went down to clean it up with a friend namede Derek. From across the street Rick (the dick) came over and told me how stupid it was blah blah. There wasn't much of an arguement. I explainied why i did it and how i made sure noone was there.

The next day i get a notice that I'm being written up. Rick wrote me up claiming that I almost hit him with the keyboard. I immediately went to the RD and was like WTF. The hell i did. Then rick changed his story that he was coming out of the bottom area with a guest. I called him on it again saying wtf were you doing down the street. Not being there directly this was taking weeks.

The problem here is that the RA had too much problem and you CANNOT give up fighting something like this. I fought for 2 months through christmas and into the next semester. You know what happened? I never did a god damn bit of punishment. But the RA walked away without ANY reprimand for lying out his ass.

He was a power hungry bastard who got what he deserved in the end. People started setting off stink bombs, glueing his door shut, etc. Of course I had something to do with all this. There's no way that Rick could have pissed off anyone else in that door. Hell, when HALF the people on the first floor (where Rick was) MOVED OUT because of harassment of Rick you'd think something was wrong. I remember two guys even going to the Student Council about him and nothing was done.

I think in the end his car's tires were flattened and his car vandalized so many times he moved. I honestly don't remember. I got the hell out of that dorm.

The point I'm trying to make is that this Chick, is just a power hungry bitch. Self righteous, goody girl.

What people forget is college is a place to learn not only scholastically but as a person. When you are harped on like big brother it only instills Rage. There are a thousand things this RA could have done differently but this was done in spite. Now that her name is known she is most probably going to experience a new level of harassment and fear.

Not because she turned someone in for drinking but because of how she did it. The mythodical cruel nature of it. Karma comes back and bites you in the ass. I guarantee i wouldn't hire her that's for sure.

I almost pity her because I'm nice, I've seen how cruel people can be when revenge is concerned or their freedom is threatened. Honestly I would move if I were her.
